So, before you use the CapeDays guide at CapeDays.com to research, reserve, or  rent any lodging accommodations, please read the information below.

Definitions

"Website" - This website, the CapeDays guide at CapeDays.com

"We" or "Us"- This Website and its owner

"You" or "Your"- All users of this Website, including but not limited to lodging owners, agents, and travelers as defined below

"Lodging" or "Lodgings" - All accommodations whatsoever, including but not limited to those in hotels, motels, B&Bs, inns, vacation rentals, campgrounds, and timeshares

"Lodging Owners/Agents"- Those who own a Lodging, and their agents

"Travelers" - persons (other than Lodging Owners/Agents) who use this Website for any Lodging-related purpose 


Lodging Information on This Website

This Website provides general travel information. On certain pages of the Website, We may exhibit and facilitate the exchange of information regarding third-party-owned Lodgings. 

We do not own, operate, or have any control over any Lodging shown on this Website.  

We are not a party to the actual transaction between any Lodging Owner and any Traveler, regardless of the fact that We may, from time to time, provide tools for Lodging Owners/Agents and Travelers, including but not limited to contact forms or third-party website links which may enable a Traveler to contact a Lodging Owner and/or enter into a transaction to rent or lease a specific Lodging directly from the Lodging Owner.

We do not handle payments, guarantee transactions, provide escrow services, or offer "buyer protection" or "lodging certification". We do not undertake to screen each Lodging offering, nor do We pre-qualify or screen Travelers for Lodging Owners/Agents.

Due Diligence Required  

** Lodging Owners/Agents and Travelers must conduct their own due diligence!!

We have no control over, and We shall not be responsible for, the quality, safety or legality of any Lodging. Although We strive to provide accurate, up-to-date Lodging information, We do not warrant or guarantee the accuracy of any Lodging information on this Website. We also do not warrant or guarantee the ability of any Lodging Owner to rent a Lodging, or the ability of any Traveler to pay for his/her Lodging.
  
Entering into any agreement or transaction with a third party involves certain risks, including but not limited to the risk of dealing with unknown persons, foreign nationals, underage persons, the safety and condition of the Lodging, or people acting under false pretenses. 

Your use of this Website constitutes Your agreement to assume all risks associated with Your dealings with Lodging Owners/Agents, Travelers, and any other persons or entities with whom You may interact, either directly or indirectly, by Your use of this Website. 

Your use of this Website also constitutes Your acknowledgment and agreement that  the information provided on this Website is not a sufficient basis for making a decision with respect to entering into a Lodging-related transaction.

It is your responsibility to do your own due diligence before you agree to any Lodging transaction, including but not limited to: verifying the Lodging's location, facilities, amenities, services, room rates, extra charges, check-in and check-out times, etc., and reading and fully understanding all applicable cancellation policies. 

You expressly agree to perform, and to rely solely upon the results of, Your own independent due diligence when entering into any Lodging-related transaction.

Limitation of Liability

You agree that We will not be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with Your use of this Website.


APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF LIABILITY SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. IF ALL OR ANY PART OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF AFFORDABLE CAPE COD VACATIONS AND ITS OWNER UNDER SUCH CIRCUMSTANCES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
